Land lease contract: inter-branch relations of civil and land law at various development stages of the obligation relationship

The inter-branch relations of civil law and land law at various development stages of the obligation relationship arising on the basis of the land lease contract, have their own features. At the stage of concluding the land lease contract, the author detects the lack of a common terminology in the field of restrictions of the turnover of a land plot. Civil legislation, unlike land legislation, does not use the concept of “objects of civil rights withdrawn from turnover”. At the stage of changing the land lease contract, dispositive possibilities are much narrowed in comparison with “classical” contractual design of the land lease. At the stage of termination of the land contract, land legislation provides additional grounds for its termination, which reinforces the manifestation of the public orientation of civil regulation of the relevant relations.
