Treaty principle of peoples sovereignty. Political-legal aspects of the problems of the electoral system of the contemporary Russia

The problems of post-Soviet spaces societies are linked to such categories as transformation, transition, development, etc. Right now they define the compliance of legal and political institutions, as well as civil society to the processes of modernization. In this regard, the aim of this paper is to identify the factors which prevent the spread of democratic rules and norms, reinforcing the social-cultural position of Russian citizens. The author of this article considers such issues as the dual character of the transition policy that combines elements of conformist political-legal culture; attempts to implement policy only from the top-down; a distortion of the principles of peoples sovereignty and the treaty between the society and the state. Special reference is paid to the need to establish a new electoral policy and mechanisms of compliance of the policy to social interests and demands of citizens of the contemporary Russia. The methodological framework is the set of sociological, cultural, anthropological, legal and political science approaches. The use of the institutional, structural-functional, dynamic and semantic methods provides a tool to indentify formal and informal relationships of the state and the society. The novelty of this paper is that the author offers the model of peoples sovereignty and its practical importance for post-Soviet societies and primarily for Russia. In this article there are indentified problems of the legal system, the idea of implementing reforms in the field of electoral law in accordance with the Universal Declaration of Human Rights, the need in existence of civil disobedience institution as a way to protect social demands of citizens.
