Contracts between Owners of Transport Infrastructures in Railway Transport during Freight Transportation

The article is devoted to the problem of legal regulation of organizational relations between owners of transport infrastructures. At present, owners of transport infrastructures conclude among themselves organizational transport contracts mainly in the form of unnamed by law, which often leads to their subsequent reclassification by courts into those types, which are enshrined in Section IV of the Civil Code of the Russian Federation (CC RF). Such agreements are still poorly studied, and there is no consensus in the literature regarding their legal nature. The text presents the signs of such contracts and, based on them, formulates the author’s definition of the concept of “contracts between owners of transport infrastructures”, which is proposed to be fixed at the legislative level in the subsection to Chapter 40 of the Civil Code of the Russian Federation “Organization of transportation”.
