Proving the facts of unlawful acts in the context of digitalization of society

This article deals with the problem of proving the facts of unlawful acts in the conditions of digitalization of society. The author describes the general theoretical aspects of the process of proving unlawful acts, as well as approaches to this concept. Special attention is paid to the problem of determining the stages of proof, which include the preinterpretation activity of the subjects of proof; the actual receipt of evidence indicating the fact of an unlawful act; the interpretation of the evidence obtained and their assessment. The article also examines the features of providing electronic evidence and the need for additional legislative regulation of this issue. Separately, non-traditional methods of obtaining evidence are considered, in particular, obtaining information using a polygraph. The author reveals new ways of committing unlawful acts in social networks. In particular, the facts of causing harm when performing challenges.
