The lawyer access to materials of pre-trial criminal proceedings: history and modernity

The author considers peculiarities of the lawyer access to the materials of the pretrial proceedings in a criminal case. The author came to the conclusion that the legislation should contain rules on the implementation procedure of the defender's powers at the stage of pre-trial investigation and in court; the relevant rules must be mechanisms of influence on the defender, who, abusing their authority, hiding behind the status bar, makes the frankly illegal actions.
