Pre-trial agreement on cooperation (cooperation agreement) in the systems of criminal legislation norms in the Russian Federation and the Republic of Kazakhstan

The place of a pre-trial agreement on cooperation in the systems of criminal legislation norms in the Russian Federation and the Republic of Kazakhstan is considered in the article taking into account different approaches to determining the legal nature of the mentioned institution as well as peculiarities of legal regulation of sentencing in the presence of mitigating circumstances. As a result, some changes of Part 1 of Art. 61 and of Parts 2 and 4 of Art. 62 of the Criminal Code of the Russian Federation, as well as changes of Part 3 and 6 of Art. 55, Arts. 67, 72 and 73 of the Criminal Code of the Republic of Kazakhstan are proposed by the author.
