State Trust in Society as a Factor of Effective Legal Regulation

Introduction: successful interaction between the state and society presupposes a high level of mutual trust. At the same time, the greatest attention of researchers is given to the issue of public trust in the state, which does not allow us to fully explore the specifics of building trust relations between the state and society, which affect the results of political and legal processes, including the effectiveness of legal regulation. The purpose of the study is to reveal the features of the formation and manifestation of the state’s trust in society in various spheres of public life, which determines the degree of effectiveness of legal regulation. Methods: the research is based on the general scientific and specific scientific methods of cognition. Results: the state’s trust in society can be manifested through the legal regulation of public relations. The level of trust of the state in society influences the setting of limits for the realization of human and civil rights and freedoms, the position of the state in proving the legality of citizens’ behavior, the formation of the legal foundations for citizens’ participation in public associations, the development and legal consolidation of social support measures, the establishment of legal guarantees for the realization of social rights, the definition of forms of citizen participation in international legal relations. The degree of trust is important in all spheres of public life, but especially in the social sphere, aimed at improving the well-being of citizens. A low level of trust or lack of it creates prerequisites for the intensification of state control over all spheres of public relations, which can lead to redundancy of legal regulation and, as a result, a decrease in its effectiveness. Conclusions: the state’s trust in society is one of the sides of public trust necessary for building a partnership model of relations between the state and society. The equal participation of the state and society in solving socially significant problems, as well as compliance with the conditions for building trusting relationships, contribute to improving the effectiveness of legal regulation.
