Terms of Use of the SciUp.org Site
The SciUp publication platform is represented by LLC "MOBILE READING TECHNOLOGIES", a company registered in the Russian Federation andproviding information services under Russian law.
To use the Platform, you need to carefully read the terms of these Rules, which constitute a public agreement for the provision ofinformation services concluded between LLC "MOBILE READING TECHNOLOGIES", represented by General Director Viktoria Olegovna Rubezhanskaya actingunder the charter, and the Platform User.
These Rules are a public offer in accordance with Article 437 of the Civil Code of the Russian Federation.
Please note that, for publishers or authors to publish and post materials, acceptance of these Rules is sufficient and no license agreements are required, because the SciUp publication platform, in accordance with these Rules and the provided functionality, operates as a social network and is an information intermediary as defined in Article 1253.1 of the Civil Code of the Russian Federation, giving registered publishers the right to independently publish, post, delete, edit, and set access modes for published documents.
When using the Platform for commercial purposes, and also at the request of the publisher or author, these Rules provide for conclusion of an additional agreement in writing or using an electronic digital signature.
LLC "MOBILE READING TECHNOLOGIES" provides you with access to the SciUp publication platform website (sciup.org) and its functionality under an agreement for the provision of information services, which is the subject of these Terms of Use.
1. Terms used in these Rules
- 1.1. The SciUp Site (or Site) is an Internet resource consisting of a set of (a) computer programs (program code executed on computers) and (b) information (Content) posted by Users. The SciUp Site is contained in an information system that makes such information available on the Internet at the network address (domain name): sciup.org including all levels of that domain, both those operating on the date the User accepts these Rules and those launched and put into operation during the entire term of these Rules.
- 1.2. Content means publications, information, and documents posted by a Site User, including in particular results of intellectual activity such as, but not limited to, scientific, educational, and literary works, graphics and design, and photographic works.
2. Status of the SciUp Site
- 2.1. Rights to the Site as a whole and to use of the network address (domain name) sciup.org belong to the Site Administration. The latter provides access to the Site to all interested persons in accordance with these Rules and the current legislation of the Russian Federation.
- 2.2. These Rules establish the conditions under which rights to use information and results of intellectual activity, including but not limited to scientific, educational, literary works, graphics and design, and photographic works, within individual sections of the Site belong to Site Users who independently created and/or posted those objects on the Site without direct participation of the Site Administration.
3. Status of the SciUp Site Terms of Use
- 3.1. These Rules for using the SciUp Site (hereinafter, the Rules) were developed by the Site Administration and define the conditions for use and development of the Site, as well as the rights and obligations of its Users and the Administration. The Rules also apply to relations connected with the rights and interests of third parties who are not Site Users but whose rights and interests may be affected as a result of actions by Site Users.
- 3.2. These Rules are a legally binding agreement between the User and the Site Administration, the subject of which is the Administration's provision to the User of access to use the Site and its functionality. In addition to these Rules, the agreement between the User and the Site Administration includes all special additional agreements and documents governing access to use separate, including Additional, Site functionality posted in the relevant sections of the Site on the Internet.
- 3.3. The User must fully read these Rules before registering on the Site. Registration of the User on the Site means the User's full and unconditional acceptance of these Rules in accordance with Article 438 of the Civil Code of the Russian Federation.
- 3.4. These Rules may be changed and/or supplemented by the Site Administration unilaterally without any special notice. These Rules are an open and publicly available document. The current version of the Rules is available on the Internet at: sciup.org/rules. The Site Administration recommends that Users regularly check the terms of these Rules for changes and/or additions. Continued use of the Site by the User after changes and/or additions are made to these Rules means that the User accepts and agrees to such changes and/or additions.
- 3.5. These Rules may be supplemented by additional agreements concluded in writing between the Site Administration and Users.
4. SciUp Site Administration
- 4.1. In these Rules and other special documents posted on the Site, the Administration of the SciUp Site (hereinafter, the Site Administration or Administration) means Limited Liability Company "MOBILE READING TECHNOLOGIES", a legal entity established under the laws of the Russian Federation.
- 4.2. Requests, proposals, and claims from individuals and legal entities to the Site Administration in connection with these Rules and all mattersconcerning the operation of the Site, violations of the rights and interests of third parties in the course of its use, as well as requests frompersons authorized under the legislation of the Russian Federation, may be sent to the postal address of LLC "MOBILE READING TECHNOLOGIES": 53Mendeleeva St., Office 1, Aksay, Rostov Region, 346720, Russia, and may also be duplicated to the email address: support@sciup.org
- 4.3. With respect to operation and development of the Site, the Administration is guided by the legislation of the Russian Federation, these Rules, and other special documents that have been or may be developed and adopted by the Site Administration to regulate provision of access for Users to individual Site functions.
- 4.4. No provisions of these Rules grant the User the right to use the company name, trademarks, domain names, or other distinctive marks of the Site Administration. The right to use the company name, trademarks, domain names, and other distinctive marks of the Site Administration may be granted only under a written agreement with the Site Administration.
- 4.5. The Site Administration may, but is not obliged to, and also does not have the technical and organizational ability to review the Site for prohibited Content. Upon receiving a complaint from a rights holder or other persons, the Administration may delete or move, without warning, any Content that, in the Administration's opinion, violates these Rules, the legislation of the Russian Federation, and/or may violate rights, cause harm, or threaten the safety of other Users or third parties.
- 4.6. Content, information, or instructions posted on the Site do not mean support or approval of such actions by the Administration. A link to any website, product, service, or any commercial or non-commercial information posted on the Site is not an endorsement or recommendation of those products or services by the Administration.
5. User status and registration on the SciUp Site
- 5.1. User registration on the Site is free, voluntary, and performed at the Internet address: sciup.org/registration
- 5.2. A Site User is an individual or legal entity using the Site, registered on the Site in accordance with the procedure established by these Rules, having reached the age permitted under the legislation of the Russian Federation for acceptance of these Rules, and having the corresponding authority (hereinafter, the User).
- 5.3. When registering on the Site, the User must provide the Site Administration with necessary, accurate, and up-to-date information to create the User's personal page, including a unique login for each User, meaning an email address or a combination of Latin letters and digits for signing in to the Site, an access password for the Site, and the User's last name and first name. The Site registration form may request additional information from the User.
- 5.4. The User is responsible for the accuracy, relevance, completeness, compliance with the legislation of the Russian Federation, and freedom from third-party claims of information provided during registration.
- 5.5. After providing the information specified in clause 5.3 of these Rules, the User must pass a number of verification procedures, namely: (a) confirm registration by recognizing an automated test designed to distinguish computers from humans ("captcha"); (b) confirm registration by activating the personal page through a message sent by the Site Administration to the User's email address. If all registration steps are completed correctly and sequentially, a personal page with a network address of the form https://sciup.org/id[number] is created on the Site. The User may register no more than one personal page on the Site.
- 5.6. By registering, the User agrees to these Rules and assumes the rights and obligations specified in them that are related to use and operation of the Site. The User receives full access to use the Site functionality.
- 5.7. After the User successfully registers on the Site, the Administration assumes the rights and obligations toward the User specified in these Rules.
- 5.8. Processing of personal data
- 5.8.1. Processing of the User's personal data is carried out in accordance with the legislation of the Russian Federation.
- 5.8.2. Personal data is used only to perform the terms of the agreement provided for by these Rules and solely for the purpose of providing the User with access to use the Site functionality.
- 5.8.3. The personal data received is not distributed or provided to third parties.
- 5.8.4. The User independently determines which personal data may be made publicly available.
- 5.8.5. The User may at any time delete personal data or change the access mode for personal data using the Site functionality.
- 5.8.6. The Site Administration takes all necessary measures to protect the User's personal data from unlawful access, alteration, disclosure, or destruction.
- 5.8.7. Disclosure of information provided by the User may be made only in accordance with the current legislation of the Russian Federation, at the request of a court or law enforcement agencies, and in other cases provided for by the legislation of the Russian Federation.
- 5.8.8. Personal data is stored on servers located in the territory of the Russian Federation.
- 5.8.9. The Site Administration also processes non-personalized (anonymized) data about the User's use of the Site, including cookies, information about use of services such as search queries, and other data, in order to provide the User with access to use the Site functionality.
- 5.8.10. By accepting the terms of the agreement provided for by these Rules, the User gives consent to the processing of personal data.
- 5.9. The login and password chosen by the User are necessary and sufficient information for the User's access to the Site. The User may not transfer the login and password to third parties and is fully responsible for their safekeeping, independently choosing the method of storage. On the hardware and software used by the User, the User may allow storage of the login and password, using cookies, for subsequent automatic authorization on the Site.
- 5.10. Unless the User proves otherwise, any actions performed using the User's login and password are considered to have been performed by the corresponding User. In the event of unauthorized access to the User's login and password and/or personal page, or disclosure of the login and password, the User must immediately notify the Site Administration in the established manner.
- 5.11. After registration, the User receives the right to independently create, use, and post Content and to determine the content of the User's own personal page and the conditions of access by other Users to its content and posted Content.
- 5.12. The User, as the owner of information posted on the User's own personal page, understands that, except in cases established by these Rules and the current legislation of the Russian Federation, the Site Administration does not participate in the formation or use of content or in controlling other users' access to the User's personal page. By posting information on the personal page, including personal data, the User understands and agrees that such information may be accessible to other Internet users, taking into account the architecture and functionality of the Site.
6. Specifics of creating and using a Publisher profile
- 6.1. The Publisher profile is intended for use by legal entities or individual entrepreneurs engaged in publishing activity (hereinafter, Publishers). A registered User may create a Publisher profile in the interests of a Publisher if the User is the lawful representative of that Publisher or another business entity engaged in publishing activity.
- 6.2. When creating and administering a Publisher profile, including when registering a subdomain name used to address the Publisher profile page, the User confirms that the User acts on lawful grounds (for example, under a power of attorney), has all necessary rights, and does not violate the lawful rights and interests of third parties or the current legislation of the Russian Federation, including legislation on competition and exclusive rights to results of intellectual activity and means of individualization.
- 6.3. In a Publisher profile, including in its description and main photo, it is not permitted to post Content if the Publisher registered under that profile does not have exclusive rights to post the results of intellectual activity in the Content posted on the Site.
- 6.4. In a Publisher profile, including in the description and main photo, posting third-party commercial and political advertising is not permitted.
- 6.5. The User is fully responsible for actions related to creating and administering a Publisher profile, in accordance with the current legislation of the Russian Federation, international legal acts, and these Rules.
- 6.6. If a violation in the Publisher profile of the lawful rights and interests of third parties, the legislation of the Russian Federation, or these Rules is discovered, the Site Administration may, at its discretion, take the following measures: (a) delete Content and other information from the Publisher profile and/or block access to it; (b) block access for the User administering the Publisher profile; (c) transfer the rights to administer the Publisher profile and the right to use the registered subdomain name to the lawful rights holder who has duly confirmed its rights to the Content posted under the Publisher profile, including rights to copyright objects, related rights, and means of individualization; (d) exclude the Publisher profile from the search system and/or block it; (e) temporarily prohibit publication of any Content in the Publisher profile.
- 6.7. A User who is the administrator and moderator of a Publisher profile is fully responsible for moderating and blocking Content posted on the pages of the Publisher profile under that User's control. If Content appears on the pages of the Publisher profile under that User's control that contradicts the Site Rules or the current legislation of the Russian Federation, the User who is the administrator and moderator of the Publisher profile must take measures to remove the relevant materials from those pages.
- 6.8. When using a Publisher profile for commercial purposes, these Rules are supplemented by an additional agreement concluded in writing between the Site Administration and the Publisher.
- 6.9. The system provides a publisher authentication procedure whose purpose is to verify that the administrator acting on behalf of the publisher is actually related to that publisher and is authorized to represent the publisher's interests on the SciUp publication platform project.
- 6.10. To protect publishers' rights, authentication of a newly created publisher on the project is performed by the SciUp project administration sending an email to the address publicly listed on the publisher's official website on the Internet. In some cases, employees of the SciUp publication platform may also request additional documents from the publisher confirming the administrator's authority.
- 6.11. By posting legally owned content on the Site, the Publisher grants other users a non-exclusive right to use it solely within the functionality provided by the Site and in accordance with clause 8 of these Rules.
7. Obligations of the SciUp User
- 7.1. When using the Site, the User must:
- 7.1.1. Comply with the provisions of the current legislation of the Russian Federation, these Rules, and other special documents of the Site Administration;
- 7.1.2. Provide accurate, complete, and up-to-date data during registration and keep it updated;
- 7.1.3. Inform the Site Administration of unauthorized access to the personal page and/or unauthorized access to and/or use of the User's password and login;
- 7.1.4. Not provide other Users with access to the User's own personal page or to individual information contained on it if this may lead to violation of the legislation of the Russian Federation and/or these Rules or special documents of the Site Administration;
- 7.1.5. Not post on the personal page information and objects, including links to them, that may violate the rights and interests of other persons;
- 7.1.6. Before posting information and objects, including but not limited to images of other persons and texts of various content, preliminarily assess the legality of their posting;
- 7.1.7. Keep confidential and not provide to other Users or third parties any personal data learned as a result of communication with other Users or other use of the Site, including but not limited to home addresses, telephone numbers, email addresses, passport data, banking information, and information about the private life of other Users and third parties, without obtaining the relevant prior permission from those persons;
- 7.1.8. Back up information stored on the User's personal page that is important to the User.
- 7.2. If there are doubts about the legality of certain actions, including posting information, Content, or providing access, the Site Administration recommends refraining from such actions.
- 7.3. When using the Site, the User is prohibited from:
- 7.3.1. Register as a User on behalf of or instead of another person. Registration on behalf and by instruction of another individual or legal entity is possible provided the necessary authority is obtained in the manner and form required by the legislation of the Russian Federation;
- 7.3.2. Mislead Users regarding one's identity by using the login and password of another registered User;
- 7.3.3. Distort information about oneself or one's relations with other persons or organizations;
- 7.3.4. Upload, store, publish, distribute, provide access to, or otherwise use any information that:
- (a) contains threats, discredits, insults, defames honor, dignity, or business reputation, or violates the privacy of other Users or third parties;
- (b) violates the rights of minors;
- (c) is vulgar or obscene, contains pornographic images and texts, or scenes of a sexual nature involving minors;
- (d) contains scenes of inhumane treatment of animals;
- (e) contains a description of means and methods of suicide or any incitement to commit it;
- (f) promotes and/or incites racial, religious, or ethnic hatred or hostility, or promotes fascism or the ideology of racial superiority;
- (g) contains extremist materials;
- (h) promotes criminal activity or contains advice, instructions, or guides for committing criminal acts;
- (i) contains restricted-access information, including but not limited to state and commercial secrets and information about the private life of third parties;
- (j) contains advertising or describes the attractiveness of using narcotic substances, including "digital drugs" (audio files that affect the human brain through binaural rhythms), information on distribution of drugs, recipes for their manufacture, or advice on their use;
- (k) is fraudulent in nature;
- (m) and also violates other rights and interests of individuals and legal entities or requirements of the legislation of the Russian Federation.
- 7.3.5. Illegally upload, store, publish, distribute, provide access to, or otherwise use intellectual property of Users and third parties;
- 7.3.6. Send mass messages to other Site Users without their consent;
- 7.3.7. Use software or perform actions aimed at disrupting the normal operation of the Site or Users' personal pages;
- 7.3.8. Upload, store, publish, distribute, provide access to, or otherwise use viruses, trojans, and other malicious programs;
- 7.3.9. Use automated scripts, programs, bots, or crawlers without special permission from the Site Administration to collect information on the Site and/or interact with the Site and its functionality;
- 7.3.10. In any way, including but not limited to deception, abuse of trust, or hacking, attempt to gain access to another User's login and password;
- 7.3.11. Illegally collect and process personal data of other persons;
- 7.3.12. Use the Site in any way other than through the interface provided by the Site Administration, except where such actions have been expressly permitted to the User under a separate agreement with the Administration;
- 7.3.13. Reproduce, duplicate, copy, sell, conduct trade operations with, or resell access to use of the Site, including its Additional functionality, for any purpose, except where such actions have been expressly permitted to the User under a separate agreement with the Administration;
- 7.3.14. Post commercial and political advertising outside special sections of the Site established by the Site Administration;
- 7.3.15. Post any other information that does not correspond to the purposes for which the Site was created, infringes the interests of Users, or is otherwise undesirable for posting on the Site;
- 7.4. The User is personally responsible for Content and any information the User posts on the Site, communicates to other Users, and for any interactions with other Users carried out at the User's own risk.
- 7.5. If the User disagrees with these Rules or their updates, the User must stop using the Site and inform the Site Administration in the established manner.
8. Terms concerning intellectual rights
- 8.1.The SciUp publication platform is an information intermediary as defined in Article 1253.1 of the Civil Code of the Russian Federation, giving registered Users the right to independently upload, post, publish, make available to the public, and set access modes for Content posted on the Site. Published or posted Content is treated by the Administration directly as an object of exclusive rights of Site Users who are lawful rights holders, unless third parties challenge otherwise.
- 8.2. The Site Administration does not verify whether the User has exclusive rights to results of intellectual activity in relation to published Content, does not modify published Content, is not the initiator of Content transmission, and does not determine the recipient of the Content.
- 8.3. The User may not upload, post, transmit, or publish Content on the Site unless the User has the corresponding exclusive rights to the results of intellectual activity in that Content and the right to perform such actions, acquired or transferred to the User in accordance with the legislation of the Russian Federation.
- 8.4. In addition to the User's own Content for which the User has rights to the results of intellectual activity, the User may upload and post on the Site Content that is not subject to exclusive rights because it has entered the public domain under the legislation of the Russian Federation, or other lawful Content that is not subject to exclusive rights and does not require permission from the author under the legislation of the Russian Federation, provided that authorship and other requirements of copyright law are observed.
- 8.5. The User is granted the right to upload and post on the Site Content distributed under an open license as defined in Article 1286.1 of the Civil Code of the Russian Federation, provided that the terms of that open license grant third parties the right to publish, distribute, and make that Content available to the public, and provided that other conditions of the open license established by the rights holder are observed.
- 8.6. The User may not upload, post, or otherwise make Content available to the public without the rights holder's consent to such actions.
- 8.7. The User may not upload, store, publish, post, or distribute Content specified in clause 7.3.4 of these Rules.
- 8.8. Non-exclusive right to Content posted on the Site.
- 8.8.1. By posting Content on the Site that legally belongs to the User, the User grants other users a non-exclusive right to use it solely within the functionality provided by the Site, by viewing, downloading (including copying), and exercising other rights solely for personal non-commercial use. Use of the received Content is permitted only if all authorship marks, copyright notices, or other authorship notices are preserved, the author's name is kept unchanged, and the work is kept unchanged.
- 8.8.2. Except in cases established by these Rules and the current legislation of the Russian Federation, no Content may be copied, reproduced, modified, distributed, displayed in a frame, published, downloaded, transmitted, sold, or otherwise used in whole or in part without prior permission from the rights holder, except where the rights holder has expressly consented to free use of the Content by any person. Reproduction, copying, collection, systematization, storage, transfer of Content for the purpose of creating a database for commercial and/or non-commercial purposes, and/or use of Content in whole or in part, regardless of the method of use, is not permitted without the Administration's consent.
- 8.8.3. Any use of the Site or Content other than as permitted in these Rules, or in the case of express consent of the rights holder for such use, without prior written permission of the rights holder is strictly prohibited.
- 8.8.4. Unless otherwise expressly established in these Rules, nothing in these Rules may be considered a transfer of exclusive rights to Content.
- 8.9. Liability for violation of exclusive rights.
- 8.9.1. The User is personally responsible for any Content or other information that the User uploads, posts, or otherwise makes available to the public on or through the Site.
9. Operation of the SciUp Site and liability for its use
- 9.1. Users are responsible for their own actions in connection with creation and posting of Content and other information on the Site, in accordance with the current legislation of the Russian Federation. Violation of these Rules and the current legislation of the Russian Federation entails civil, administrative, and criminal liability.
- 9.2. The Site Administration provides the technical ability for Users to use the Site, does not participate in forming the content of personal pages or User-posted Content, does not control, and is not responsible for actions or inaction of any persons regarding use of the Site or formation and use of Content and User pages on the Site.
- 9.3. The Site information system and its software contain no technical solutions that automatically censor or control Users' actions and information relations in connection with use of the Site.
- 9.4. The Administration reserves the right at any time to change the design of the Site, its content and functionality, to change or supplement the scripts, software, and other objects used or stored on the Site, and any server applications, with or without prior notice.
- 9.5. The Site Administration does not perform preliminary or subsequent moderation of Content or censorship of information posted by Users, and takes actions to protect the rights and interests of persons and ensure compliance with the requirements of the legislation of the Russian Federation only after an interested person contacts the Site Administration in the established manner.
- 9.6. The Site Administration is not responsible for a User's violation of these Rules and reserves the right, at its own discretion and upon receiving information from other users or third parties about a User's violation of these Rules, to change, moderate, block, or delete any information and Content published by the User that violates the prohibitions established by these Rules, and to suspend, restrict, or terminate the User's access to all sections or functions of the Site. The Site Administration reserves the right to delete the User account and/or suspend, restrict, or terminate the User's access to any Site functionality if the Administration determines that the User poses a threat to the Site and/or its Users.
- 9.7. Deletion of the User's personal page means automatic deletion of all information posted on it, as well as all User information entered during registration on the Site. After deletion of the personal page, the User loses access to use of the Site.
- 9.8. The Site Administration ensures the operation and availability of the Site and undertakes to restore its operation promptly in the event of technical failures and interruptions. The Site Administration is not responsible for temporary failures and interruptions in the operation of the Site or for loss of information caused by them. The Administration is not responsible for any damage to the User's or another person's computer, mobile devices, other equipment, or software caused by or related to downloading materials from the Site or from links posted on the Site.
- 9.9. The Site Administration has the right to dispose of statistical information related to the operation of the Site, as well as User information, in order to provide targeted display of advertising information to different audiences of Site Users. For the purposes of organizing the operation and technical support of the Site and performing these Rules, the Site Administration has the technical ability to access Users' personal pages, which it exercises only in the cases established by these Rules.
- 9.10. The Site Administration has the right to send the User information about development of the Site and its functionality, as well as to advertise its own activities.
10. Limitation of liability of the Site Administration:
- 10.1. The Site and its functionality, including all scripts, applications, content, and site design, are provided "as is." The Administration disclaims any warranties that the Site or its functionality may or may not be suitable for specific purposes of use. The Administration cannot guarantee and does not promise any specific results from use of the Site and/or its functionality;
- 10.2. To avoid misunderstandings, the User should take precautions when downloading from the Site or from links posted on it and when using any files, including software. The Site Administration strongly recommends using only licensed software, including antivirus software;
- 10.3. By using the Site, the User agrees that the User downloads any materials from or through the Site at the User's own risk and is personally responsible for possible consequences of using those materials, including damage that this may cause to the User's computer or to third parties, data loss, or any other harm;
- 10.4. Under no circumstances shall the Site Administration or its representatives be liable to the User or to any third parties for any indirect, incidental, or unintentional damage, including lost profit or lost data, or damage to honor, dignity, or business reputation caused in connection with use of the Site, Site content, or other materials to which you or other persons obtained access through the Site, even if the Site Administration warned of or indicated the possibility of such damage.
11. Final provisions
- 11.1. These Rules constitute an agreement between the User and the Site Administration regarding the procedure for using the Site and its functionality and replace all previous agreements between the User and the Administration.
- 11.2. These Rules are governed by and interpreted in accordance with the legislation of the Russian Federation. Issues not regulated by the Rules shall be resolved in accordance with the legislation of the Russian Federation.
- 11.3. In the event of any disputes or disagreements related to performance of these Rules, the User and the Site Administration will make every effort to resolve them through negotiations between them. If the disputes are not resolved through negotiations, they shall be resolved in the manner established by the current legislation of the Russian Federation.
- 11.4. These Rules enter into force for the User from the moment the User accedes to them and remain in effect for an indefinite period.
- 11.5. These Rules are drawn up in Russian and may be provided to the User for review in another language. In the event of any discrepancy between the Russian-language version of the Rules and a version of the Rules in another language, the Russian-language version of these Rules shall apply.
- 11.6. If, for any reason, one or more provisions of these Rules are found invalid or without legal force, this does not affect the validity or applicability of the remaining provisions.
