Actual basis of property right absoluteness

On the example of property relations, the peculiarities of the actual grounds of an absolute legal relationship are considered. It is indicated that, by virtue of publicity of the property relationship, the legal facts underlying it must be available for perception by all other persons. Possession and registration are considered as legal facts ensuring the publicity of property rights. The author points out that with respect to movables, the publicity of the right of ownership provides possession. It is noted that the provision of publicity of real rights to immovable things, by virtue of their essence, can be achieved only by registration, which is why it is necessary to ensure the absolute reliability of the register of rights to real estate.
