Optional declaration as the second level of recognition of the competence of the African Court of Human and Peoples' Rights

The article offers an overview of the forms and contents of the declarations accepting jurisdiction of the African Court, made in accordance with paragraph 6 of article 34 of the Protocol of the African Court on Human and Peoples' Rights. Since States are free to choose the form, the author first considers the essence of the concept of "consent" of States in the exercise of the jurisdiction of the international court of Justice dealing with the protection of human rights. In order to improve the system of the optional declaration of the African Court, the author proposes amendments to the protocol and rules of the African Court.
