The authors set the goal of studying the process of forming ideas and legislation on property rights in pre-revolutionary Russia. It is necessary to emphasize that it is necessary to distinguish from the tendencies of reforming legislation on real law as a natural direction of its development, attempts to accidentally, unjustifiably make changes, additions, adjustments to its content, which significantly reduces its qualitative characteristics, regulatory potential and law enforcement efficiency. The research is based on an objective dialectical method of cognition of legal phenomena and processes related to the chosen topic, the study of their relationship. In addition, the study is based on general scientific methods: analysis, synthesis, historical, logical, generalization, abstraction, system analysis, modeling, etc. The system of property rights that took shape in pre-revolutionary Russia in a number of aspects fully corresponded to the corresponding advanced European concepts of property rights for that time, while possessing its own Russian originality and peculiarities.
