Force major and business risk during the coronavirus pandemic

The article discusses the specifics of the performance of contractual obligations of business entities in relation to the period of time recognized in the world as the "coronavirus pandemic". The article analyzes the concepts of "force majeure", "business risk", and law enforcement practice on the issue of exemption from liability for non-performance or improper performance of obligations. Based on the studied normative legal acts issued during the pandemic, the article concludes that the coronavirus epidemic, as a force majeure, is not applicable to all spheres of business relations. The author emphasizes that in the current situation, the understanding of "force majeure" and "business risk" is mixed and this entails the need to review the criteria for attributing a particular circumstance to force majeure.
