The functions of presenting counsel in criminal proceedings: types and features

This work is devoted to the study of the issue of criminal proceeding’s functions, its types and the implementation by a presenting counsel. The subjects of the research are international legal norms, norms of domestic criminal procedure legislation, doctrinal positions of Russian procedural scientists. The question about the concept and types of functions in the criminal proceeding is the subject of debate for several decades, and remains relevant in today’s scientific research. The types of functions of the criminal proceeding are differentiated on various grounds, which is also the object of research. In this work, the author formulates the concept of “the function of criminal process”, identifies certain types and specifics of their implementation by presenting counsel. According to the author, presenting counsel is unjustly neglected by the legislator. Presenting counsel is an independent subject, the functions he implements during the criminal proceeding are very diverse.
