Guarantees of human rights as an element of the Russian constitutional identity

Introduction: the author analyses the concept of constitutional identity, considers historical development of constitutional guarantees. Materials and Methods: the author analyzes current Russian legislation, court practice, scientific articles and studies. In the course of the study, the author used dialectical, logical deduction, induction, and technical methods. Results: for the past decade the comprehension of constitutional identification of Russia was needed which doctrine development is ongoing. As a multidimensional and complex phenomenon, the identity is defined through various aspects including the guarantees of human rights and freedoms. Discussion and Conclusion: the paper substantiates the conclusion that legal guarantees of human rights and freedoms have a long historical tradition, have developed as a result of centuries of previous state development, historical and cultural traditions, therefore they are an element of Russian constitutional identity.
