A state civil employee as a special subject of crimes on duty

Specific features of the application of criminal responsibility to state civil employees are considered in the article. Categories of state civil employees who can be subject to criminal responsibility are analysed. Also, authors provide assessment of subjectivity of the category “state civil employee” and characteristic features of applying criminal responsibility to state civil employees in terms of their responsibilities being performed. Furthermore, the correlation between the categories of “state civil employees” and “an official” is specified in criminal law in the context of their delictual dispositive capacity. The authors’ suggestions aimed at improving legal regulations of the institute of criminal responsibility of state civil employee are to fully guarantee rights for protecting a state civil employee on applying criminal responsibility
