The article examines the legal status of the state prosecutor in Russian criminal proceedings, identifying contradictions between the provisions of the Criminal Procedure Code of the Russian Federation, Order № 376 of the Prosecutor General of the Russian Federation dated June 30, 2021, and the position of the Constitutional Court of the Russian Federation. The author criticizes the restriction of the prosecutor’s independence, who is required to coordinate the withdrawal of the accusation with the prosecutor’s office leadership, leading to his subordination to the investigator’s position and violation of the principles of adversarial proceedings. The need to expand the prosecutor’s powers to protect the defendant’s rights and ensure fair justice is substantiated, with proposals to amend the legislation to eliminate departmental pressure and enhance objectivity.
