The state as a business entity and some problems of protecting its interests

The article examines the substantive and procedural problems that arise when the state conductsbusiness activities. It is shown that it can participate in both private and public law relations, which presupposes different procedural procedures for protecting state interests. Since the procedural features of consideration of cases involving the state by arbitration courts have not been determined at present, the author proposes to limit the right of participants in these cases to conclude settlement agreements. He considers it unjustified to limit the state’s right to demand compensation for damages under a prosecutor’s claim. He proposes a criterion for determining the procedural status of a public authority in arbitration.
