Civil legal responsibility of evaluation companies and evaluators: review of judicial practice

The author reviews judicial practice in cases involving civil liability of appraisal companies and appraisers. It considers four conditions for the appraiser to be held liable. It identifies and analyzes the problems associated with them, including a causal relationship and the mandatory nature of the result of the assessment as a necessary condition for recovering losses. He comes to the conclusion that, in general, the courts correctly resolve such cases, however, they should pay special attention to the fault of the customer of the valuation, the probabilistic nature of the valuation and other factors that reduce the risks of property liability of valuers and provide a balanced approach to taking into account the interests of valuers and valuation recipients.
