Civil law basis of prohibition or suspension of dangerous activities (article 1065 of the Civil Code of the Russian Federation)

The article analyzes the legal nature of the measures provided for in article 1065 of the Civil Code of the Russian Federation and the civil law basis of their use. The author offers a dualistic concept of prevention of harm, according to which the suspension or prohibition of activity is a responsibility or a measure ofprotection. The beginning of measures may be guilt or risk. This approach provides different rules for the distribution of adverse consequences arising from the enforcement of an injunction.
