Legal features of contractual relations in the sphere of human organs and tissues transplantation

In the article, legal features of contractual relations in the sphere of human organs and tissues transplantation are considered. The features of regulation of contractual relations in the sphere of transplant treatment are established by the provisions of the Civil Code of the Russian Federation, and also by the norms of the Federal Laws «On the Basics of Protection of Public Health in the Russian Federation» and «On Human Organs and (or) Tissues Transplantation». It is established that only specialized institutions of state and municipal health care systems can provide transplant help. The content of contractual relations in the sphere of human organs and tissues transplantation depends on the donation form that can be live or cadaveric. The conclusion is drawn that contractual schemes applied when using this or that form of donation hereinafter are referred to as agreements on providing medical transplant services.
