Objective: To investigate the problem of establishing moral damages in the criminal process in Belarus, Ukraine and Russia. Consider the relationship between the concepts of «harm» and «damage.» A comparative analysis of existing methodologies, tools, and methods for determining the amount of compensation for moral damage in the criminal process. Methodology: The authors used legalistic and comparative legal methods. Results: In criminal proceedings, it is necessary to use the term «injury» as harm includes species such as loss of profits and actual damages, including caused by non-property interests. To determine the extent and nature of moral and physical suffering is necessary to appoint a comprehensive psychological and psychiatric examination. Novelty/originality/value: This article contains the author of the novel generalizations and conclusions that can be used in scientific and practical activities.
