Characteristics some crimes of corruption, committed by educators

Introduction: the analysis of judicial and law enforcement practice shows that currently the education system is subject to the negative impact of various negative factors. One of the actual criminal factors is criminality on the part of participants in the educational process, including on the part of education workers, among whom we include teachers, heads of educational organizations, counselors in summer children's camps, etc. The public danger of crimes committed by this category of citizens lies in the fact that education workers (primarily teachers) are persons who should not only transfer knowledge to their wards, but also educate them. Therefore, we believe that education workers are especially responsible for ensuring the observance of law and order and legality in society. Currently, one of the most common categories of crimes committed in the field of education is corruption-related crimes. In this regard, in this paper we will turn to the analysis of criminal-legal signs of such elements of corruption crimes committed by education workers as commercial bribery and abuse of official authority. Materials and Methods: the normative basis of the study is federal laws, including Federal law, 2012 «On Education in the Russian Federation», Federal law, 2020 «On Digital Financial Assets, Digital Currency and on Amendments to Certain Legislative Acts of the Russian Federation». The author bases his conclusions on judicial practice, which is analyzed in this study, on the decisions of the Plenum of the Supreme Court of Russia, as well as data from official state statistics. The study uses various methods, including logical deduction, induction, comparison, analysis, generalization and description The Results of the Study: allowed us to present a general criminal-legal characteristic of two types of crimes that are most often committed by education workers, namely commercial bribery and abuse of official authority. The current judicial practice on this category of cases has been studied and a number of resolutions of the Plenum of the Supreme Court of Russia affecting the issue of corruption crimes committed, including in education systems, have been analyzed. Findings and Conclusions: the description and disclosure by the author of the key criminal-legal features of the considered elements of crimes committed by educators will allow for further scientific research to develop and propose a system of effective measures to protect against them. In conclusion, the author focuses readers' attention on the fact that criminal legal counteraction to commercial bribery and abuse of official powers committed by education workers is one of the measures to combat such criminally punishable acts, and this direction of state activity is necessary for modern society, especially for the effective criminological protection of the most important state goods, values and interests, which undoubtedly include the institute of education.
