The author provides an analysis of the positions of theorists of sociological positivism, their understanding of the division of human and civil rights into groups. The article presents the most typical ideas of the scientists of this legal school of the structure and features of the possession and use of rights, criticism of other teachings in this area. It is concluded that within the framework of this doctrine, a third theory of human rights was created, equally remote from both the theory of the school of the revived natural law and the theory of legal positivism.
