The article presents the realities of the lack of a qualitative new level of development of operational investigative law in the Russian Federation, and also identifies and analyzes the reasons that served as the origins of the regressive process in the studied branch of law enforcement. The gaps in the current legislation and the consequences of their influence on the effectiveness of operational investigative practice of subjects of operational investigative activity of internal affairs bodies are emphasized. The conclusions of the study allow us to develop additional measures to eliminate the existing and eliminate, in the future, possible legal uncertainty in the optimization of regulatory legal acts regulating the operational investigative activities of internal affairs units.
