Immunity or protection from obligations in case of bank-ruptcy of citizens (individuals)

The problems of application of the insolvency (bankruptcy) legislation and the legisla-tion on enforcement proceedings in the matter of the so-called "executive", "property" immunity from debts, de facto protection from obligations are studied, an "analytical cross-section" of arbitration ju-dicial practice over the past five years on the designated issues is shown, some trends (grounds) for the application/non-application of immunity from debts (protection from obligations) are identified, a conclusion is made that does not require additional argumentation that immunity from debts, or pro-tection from obligations, is rather an exception than a doctrinal "civilistic rule", from which it fol-lows: no immunity from debts, protection from obligations in private law exists, there are only proce-dural grounds for excluding property from the procedure of enforcement proceedings.
