Information as a structural element of legal reality

The article studies information as an element of the structure of legal reality. Information appears as a unity of the material and ideal, objective and subjective in the legal reality. On the basis of the dialectical approach, information is analyzed in the context of interaction between society, the system world, legal and everyday reality. Information is an integral part of the life world of a social subject, which is mediated by law. Due to the fact that the law and its attributes are directly connected with the system world of information, legal reality appears as part of the systemic world of information and information culture. At the same time, the information culture of a person manifests itself in its information capital as the ability to understand the other and to predict and evaluate the consequences of their actions. Information capital is associated with the growth of rational development of the world with existential opportunities to return a person to the world of being, where the artificial and natural must most fully unfold. When a person finds himself in front of the power of information, his worldview program of activity hangs, as it were, before the “potency”, the possibility of being. The entire theoretical and philosophical program of human activity, as it were, stops before the sphere of the existential. The author concludes that information, as a structural element of legal reality, is connected with the existential direction of substantiating human freedom in the complex world of spiritual and material essences. Information does not want to dissolve neither in society, nor in the objective world. It, in fact, is the very freedom of the human will, aimed at increasing moral, spiritual capital. But the essence of information is still in restricting the freedom of the individual and in this aspect of it, information, as a global problem of our time, allows us to make the analysis of human history itself a filled study of its cultural, economic dominants. The article analyzes information as a structural element of legal reality. This contributes to the moral flow of thought. But only the very idea of “freedom” should not be generalized excessively.
