Institutional Foundations of Judicial Self-government

This article is devoted to the analysis of the institutional foundations of judicial self-government, considering them not only as a system for regulating internal relations in the judicial community, but also as a key element ensuring the independence and independence of the judiciary as a whole. The author focuses on the fact that the established institutional foundations act as institutional guarantees that promote the impartial and effective administration of justice. The very existence and effectiveness of judicial self-government bodies are considered as an important indicator of the maturity and stability of the judicial system, confirming its ability to self-organize and protect itself from external influence. The study emphasizes that the institutional foundations of judicial self-government are a complex and multilevel system of adopted normative legal acts that regulate a wide range of issues arising between members of the judicial community. Based on modern institutional theories, the author offers a differentiated approach to understanding these foundations, dividing them into formal and informal institutions. Formal institutions include those normative legal acts that have been adopted by legislative and executive bodies external to the judiciary, defining the general framework for the functioning of the judicial system. In contrast, informal institutions include normative legal acts developed and approved directly within the judicial authorities themselves, reflecting the specifics of judicial activity and professional ethics. This division allows for a more detailed study of the mechanisms of interaction between formal and informal norms in the process of judicial self-regulation and their cumulative impact on ensuring its independence and effectiveness.
