Institute of necessary defense: some aspects

The article deals with some theoretical and practical issues related to the implementation of the norms of the institute of necessary defense. The examples of judicial practice illustrating the application of the legislation on the necessary defense by the courts are given. The author offers recommendations for improving the current legislation aimed at ensuring the certainty of the application of the rules on the necessary defense. In particular, it is proposed to establish that it does not exceed the limits of the necessary defense of the defender in the event of violent acts or the threat of their commission against persons in a helpless state, or in the case of illegal invasion of the encroaching person in the home, which is used by the defender.
