The provisions of the Constitution of the Russian Federation form a legal foundation for the further development of the information society and information legislation in Russia. The author highlights a number of problems in the information legislation, the solution of which is an urgent task for the constitutional law of Russia. Among them, the problem of imbalance between private and public interests, competition between various constitutional rights and freedoms, as well as unconstitutional restriction of certain information rights and freedoms. The following are examples of the solution of the particular manifestation of these problems. The author calls the solution of these problems the constitutionalization of the information legislation "from top to bottom".
