Interests in Japanese constitutional law and constitutional-legal interests: estological study

Introduction: the publication deals with the development trends of the Japanese constitutional law, the formation of the national mechanism of legal regulation and mechanism of state power, the relationship between the constitutional values and anti-constitutional values fixed in the matter of the Japanese constitutional law that allows to consider, define the interests of positive constitutional law, the legal characteristics of the Japanese political system, the mechanism of state power and the objective characteristics of the legal regulation mechanism and the process of legal regulation in the state in question. Materials and Methods: the empirical data formed as a result of applying the author's latest research methodology and technology (aesthetic analysis of the mechanism of constitutional-legal regulation and the mechanism of state power), the regularities of existence of the interests of constitutional law as a social phenomenon and the interests of constitutional-legal regulation in Japan, which are inherently linked with the formation and functioning of the state power mechanism in the relevant country, are subjected to knowledge. The Results of the Study: The collection of authentic documents (sources of law, acts of law interpretation, acts of law implementation and application) of Japan was carried out and a selective approach was applied to find and confirm links of systemic or structural nature that confirm the connection of subjective political interests of the participants of social relations integrated in the matter of positive constitutional law of Japan. Findings and Conclusions: the estological study affects the forms and content of the constitutional law of Japan, its legal and technical features, the presence of the phenomenology of the interests of constitutional legal and general legal regulation is revealed, the hypothesis is confirmed. that the interests of legal regulation differ from the political interests of the subjects of constitutional law, the signs of interests in the mechanisms of legal regulation and state power in Japan correspond to the main signs of positive law and the signs of the mechanism of state power in Japan.
