Usage of personal images while committing crimes against constitutional rights: evaluation from the point of criminal law

The right to personal image is connected with several criminal law provisions, primarily - on protection of personal and family secrecy, but also on libel. The true or false nature of image often becomes a borderline between the former and the latter, in case the image itself meets other criteria of those crimes’ features. Actions with personal images are partly out of the criminal law field, although they lead to the same level of distress, as other acts already criminalized. The author suggests to draft a specific norm on images’ protection under the umbrella of privacy violations covered by the Art. 137 of the Russian Criminal Code.
