Sources of Romano-German law. The role of courts in the development of modern Romano-German law

Бесплатный доступ

The subject of this article is the sources of the law of the Romano-Germanic legal family and the role of each of them in the general structure of legal sources. As a result of the study, an analysis of such sources was carried out as: a) a normative legal act (which is central in the entire legal family, and distinguishes it from others), b) legal doctrine, c) legal custom, d) general principles of law, e) judicial precedent (initially not on the list of sources of the Romano-Germanic legal family, but recently gaining more and more weight against the background of other sources due to the strengthening of ties between the continental and Anglo-Saxon legal families).
