Historical development of the theory of people's sovereignty

In this article the author substantiates the position that all phenomenological theories about law and the state are impaired from significant blemish - they are regarding at the state as something being done, mechanical, whereas it is, in essence, the body of people associated closely with its spirit, with its civilization, nationality, reflecting all the vicissitudes of the develop- ment of the spiritual world on itself. The contributor argues that the state is inseparable from the spiritual development of the people, and therefore in the state science it is impossible to wonder about the best form of the state matter. The article author also believes that the school of formal law is just deeply mistaken when it is considering law as a national concept, and not as an idea that exists only as a regulator in us, but an infinite content, which we gradually discover with development.
