The history of the new criminal procedure type development in the medieval Germany

The problem of the inquisition process establishment in the medieval Germany is researched. The two points of view for the nature of this type of the criminal process beginning are defined: this process was either borrowed from the church court rules or it simultaneously appeared in the society and canonical law. By the end of XV - beginning of XVI centuries Germany had all the necessary conditions to legalize the inquisition process in the "Carolina" of 1532.
