The History of the formation and the current state of legislation on liability for a crime under Article 282 of the Criminal Code of the Russian Federation

The paper analyzes the pre-revolutionary, post-revolutionary and modern legislation on liability for inciting hatred or enmity, as well as humiliation of human dignity. Attention is drawn to the fact that in prerevolutionary Russia, a similar corpus delicti appeared at a later period, but in Soviet times, the first criminal codes already provided for responsibility for a socially dangerous act, the description of which, albeit in a slightly different form, is contained in Article 282 of the Criminal Code of the Russian Federation. The stages of reforming this article are considered, its inconsistency is noted. It is concluded that any change in the law should be based on the authoritative opinion of experts in the field of criminal law, as well as on historical experience.
