Historical and legal prerequisites for the establishment of the institution of procedural costs in the domestic criminal procedure legislation (XI-XVI centuries.)

The article analyzes the history of the formation of procedural costs arising from the parties in the process of development of domestic criminal proceedings. Consideration of the Genesis of the classification of procedural costs, allows for a theoretical analysis of the problem. In addition, the study of the history of the formation of legal costs allows us to identify the scientific justification of the latter. Criminal procedural analysis of procedural costs in criminal proceedings is objectively possible only when considering this phenomenon in the historical aspect.
