The article deals with the way to regulate Criminal Law, i.e. changes in penalization intensity non-related-to-differentiation-and-dedifferentiation-of-criminal-responsibility which results in changing sanction rules. The author comes to the conclusion that scientific basis of implementing changes in penalization intensity are poorly identified in the theory of Criminal Law and are not applied in law practice. New lines of research which include analysis of basis and conditions for the mentioned law regulation have been suggested.
