Changing the legal status of the Constitutional Court of the Russian Federation in the light of the constitutional reform of 2020

The article defines the content of the judicial system of modern Russia, analyzes the constitutional novelties of 2020 in terms of changes in the powers of the Constitutional Court of the Russian Federation, its composition as a whole, and the organizational foundations of the Constitutional Court. The amendments to the federal Constitutional law “On the Judicial System of the Russian Federation”, according to which the statutory constitutional courts of the subjects of the Russian Federation will be liquidated in 2023, are analyzed. The changes also affected the regulation of the status of the Constitutional Court of the Russian Federation, its relations with other state authorities. In general, it is stated that the novelties reduce the independence and independence of the Constitutional Court of the Russian Federation, can complicate its activities for the implementation of constitutional control. One of the most controversial and controversial issues today is the question of the legal nature of the decisions of the Constitutional Court of the Russian Federation and their execution. The reform of the Constitutional Court has modified its powers to consider constitutional complaints of citizens, cases on the possibility of the Russian Federation executing decisions of interstate and other similar bodies, making mandatory final decisions with the identification of the constitutional and legal meaning of the contested norm. The article analyzes the new powers of the Constitutional Court to implement preventive control of laws on amendments to the Constitution of the Russian Federation, federal and regional laws, and formulates proposals for further regulation of relations in this area from the standpoint of the need to combine preliminary and subsequent regulatory control.
