Экономические основания установления сообладания исключительным авторским правом

Статья посвящена рассмотрению института сообладания исключительным авторским правом с позиций теории стимулов, оптимизации производительности и концепции нормативного экономического анализа. С учетом наличия тенденции увеличения количества объектов интеллектуальных прав, создаваемых совместным творческим трудом, а не единолично, предпринята попытка рассмотреть основания, причины создания произведений в соавторстве. Обосновано, что в ходе законотворческой и правоприменительной деятельности необходимо проведение экономического анализа с целью формирования комплексного видения экономических последствий установления того или иного правового регулирования института сообладания исключительным авторским правом.

Economic grounds for establishing exclusive copyright ownership
The article is devoted to the consideration of the institute of the joint ownership of exclusive copyright from the standpoint of the theory of incentives, of performance optimization and the concept of normative economic analysis. The tendency to increase the number of objects of intellectual rights created by joint creative work, gives reason to consider the causes for the creation of works in co-authorship. It is proved that in the process of law-making and law-enforcement activities it is necessary to conduct an economic analysis in order to form a comprehensive vision of the economic consequences of the establishment of a legal regulation of the joint ownership of exclusive copyright.
