Extraordinary grounds and legal consequences of exemption of persons, involved in the special military operation, from criminal liability and punishment

The adoption of a specialized legal act, regulating specifics of criminal liability for persons, involved in the special military operation, has functioned as an extraordinary way to regulate grounds of exemption from criminal liability and punishment. The necessity to encourage individuals, exhibiting particularly significant behavior for the society and the State, served as the reason for the adoption of this regulatory legal act, the content of which was not sufficiently developed from a technical and legal point of view, which has led to certain significant contradictions of both a theoretical and law enforcement nature. In order to ensure compliance with the balance of interests of the society, the State and persons who have committed a crime and are participating in the special military operation, it is proposed to enshrine in the criminal legislation an independent basis for the exemption of these persons from punishment and to work out an appropriate mechanism for this basis implementation.
