The article analyzes the problem of type determination of Ihering’s legal doctrine and Weber’s sociological and legal theory. Views of both thinkers are considered in the context of the overall development directions of legal positivism that allow one to identify the legal thinking of R. Ihering and M. Weber as empirical and sociological legal positivism. The research methodology is based on general and specific scientific research methods, including philological analysis methods of the theme-rheme structure of the original text, as well as ad hoc methods used in political and legal doctrines research (structural analysis of the doctrine, reconstructive analysis, etc.).
