Stages of the formation of cassation proceedings in criminal cases: from the charter of criminal proceedings to the Code of Criminal Procedure of the Russian Federation

The article considers the stages of the formation and development of cassation proceedings in criminal cases in Russia, starting from the Charter of Criminal Proceedings of 1864 to the Code of Criminal Procedure of the Russian Federation. The author substantiates the absence of the necessity to amend the subject of cassation proceedings (Article 401.1 of the Code of Criminal Procedure of the Russian Federation), limiting its subject only to the verification of the legality of judicial acts that have entered into legal force.
