Consideration of the theoretical construction of the subject of evidence, its understanding is important for criminal proceedings. The article is devoted to the analysis of the main stages of the development of scientific and legislative ideas about the subject of evidence in domestic criminal proceedings. The historical method of research allowed the author to trace the main stages of the formation of the concept of the subject of evidence, starting from the Statute of Criminal Proceedings in 1864 to the present. A detailed analysis of the evolutionary path of formation allowed forming a critical view of the relationship between the past and the present, scientifically explaining on this basis the prospects for criminal procedural development. The author of the article explores various views, topical issues related to the understanding of the essence, content and structure of the concept of "subject of evidence" in criminal procedure science and law. The article considers the debatable question of the correlation of the subject of evidence and the circumstances to be proved, the author expresses her own position on the currently existing research problems.
