The juridical nature of the institute of legal expertise of normative legal acts and their drafts

The intensive nature of normative activity inevitably affects the quality of enacted laws and by-laws, creates a large number of gaps and conflicts and causes problems in law enforcement. The most important role in ensuring the harmony and balance of the state legal system belongs to the legal expertise of normative legal acts and their drafts, which is a «filter» of the legislative system. The insufficient development of organizational and methodological foundations for its implementation and the lack of legislative regulation of expert activities cause difficulties for both developers of normative legal acts and experts. The purpose of the study is to analyze in detail the legal institute of juridical expertise, to identify problems arising in its conduct, and to systematize the most common normative errors. The methodological background of the study is a set of general scientific (analysis, synthesis, comparison, system-structural) and specific scientific (formal-legal, comparative-legal) methods of cognition.
