The established understanding in legal science of a legal fact as a life circumstance that gives rise to legal consequences can create the following idea of it: as a phenomenon that has a certain independent value in relation to the rule of law, and also influences the effect of the rule of law. Following this logic, a change in life circumstances should be the main prerequisite for a change in the legal side of the fact, which, in turn, should affect the content of the legal relationship. However, in reality, the link between a legal fact - a life circumstance and a legal relation i.e. the rights and obligations of subjects is more complicated. The authors consider the manifestation of this link in legal relations on social security. Moreover, the article analyses the possibility of applying presumptions when assigning types of social security, with particular attention to the presumption of good faith.
