Legislative bases of the termination of the status of the lawyer: standard and legal analysis

Article is devoted to consideration of legal issues of the termination of the status of the lawyer which is one of types of disciplinary responsibility and comes for gross violation of the legislation on lawyer activity and legal profession. Today the legislation on legal profession has defined types of disciplinary punishments, however the mechanism of their application depending on concrete offense of the lawyer is accurately not defined. In article the problem of uniform approach to assignment of punishment rises that is expressed in need of a specification of nature of offense for which there comes this or that type of disciplinary punishment that demands differentiation in the Code of such types of disciplinary punishment as the remark, the prevention and the termination of the status of the lawyer.
