Legal mechanism of the right to social protection in the Republic of Kazakhstan

This article examines the institution of social protection as an effective satisfaction of the interest of individuals to receive specific types of social protection in order to prevent, overcome or mitigate the adverse effects of social risks, adapt to new living conditions. The legal mechanism of the right to social protection is carried out through the exercise of their powers by state authorities and local selfgovernment by determining the priorities of social policy, fulfilling their constitutional obligations to initiate, develop and conduct social policy in the labor and employment sphere, social protection, health, education, science, ensuring measures for the development of the social state by implementing in the life of social policy, the implementation of concepts, strategies, programs in the social sphere. The need to develop a scientifically based concept of a legal mechanism for ensuring the right to social protection is due to the modern challenges posed to the Kazakh legal science of social security law related to the transformation of sectoral public relations, the expansion of the scope of application of private law foundations when taking a set of measures aimed at preventing, overcoming or mitigating the adverse consequences of social risks, adaptation of a person or family to new conditions her vital activity, the recognition by the rule-making subjects of a significant number of events as legal facts that are the grounds for the emergence of the law under study, and the variety of their manifestations, integration processes, etc. The level of social protection of the population in the state depends on how clearly the mechanism for ensuring the right to social protection is defined in the legislation, how effective is law enforcement practice in the relevant area.
