On Some Questions about the Limits of Constitutional Human Rights in the Context of Countering Extremist Activity

In the modern world, the problem of extremism is becoming increasingly pressing, posing a threat to both the security of society and the rights and freedoms of citizens. With the growing number of extremist manifestations, the need arises for effective measures that, on the one hand, ensure the protection of society from threats while, on the other, preserving fundamental human rights. Constitutional guarantees play an important role in achieving this balance, providing the legal basis for implementing both security measures and protecting citizen’s rights and freedoms. Their fundamental significance lies in their ability to organize and regulate social relations within the strict framework of the legal field, creating barriers against arbitrariness. This function of constitutional legal regulation becomes critical when the interests of collective security and individual freedom may come into apparent conflict. Thus, the relevance of this issue stems directly from the need to find an optimal balance between ensuring security and protecting human rights and freedoms.
