On the problem of decriminalization of responsibility for economic crimes

Purpose: To study the problem of decriminalization of responsibility for economic crimes and identify the main trends of this process. Methodology: Legalistic and comparative methods were used by the author. Results: The paper is devoted to the problem of decriminalization of responsibility for economic crimes and to the main trends and determinants of this process. The author notes that there are redistribution of the repressive potential of criminal law to other branches of law, particularly administrative law; priority of reimbursement and termination of criminal proceedings over criminal law prosecution and subsequent punishment; focus on the investment factor of future changes among such tendencies. Among the determinants of liberalization there can be loss of public danger of a number of crimes and mistakes made in criminalizing these acts in terms of assessing their objective side. Novelty/originality/value: The study of the problem of decriminalization of crimes of an economic nature is necessary at the moment and because of the confirmed legislative initiative and the actual unfolding of the relevant processes in Russian public life. In anticipation of changes in the criminal law, the author refers to the content, causation and the underlying regularities of these changes.
