To the problem of the emergency of a legitimate state

The issues of the causes and features of the emergency of a legitimate state have always provoked genuine interest among researchers from various science fields. In accordance with it, there is a need for a comprehensive understanding of state law institutions based on Modern Times values. At the same time, it is especially important to disclose why some countries of the world are currently among the developed countries, while others lag behind in their development. In the essential content of the concept “legitimacy”, there are moments associated with the values, traditions and customs accepted in the society, charisma, constitutional norms, democratic elections, referendum or plebiscite, which are simultaneously conditioned by the development of civil society and the rule-of-law state. Simultaneously, the need to address the problem of the legitimacy of the state requires taking up more correct positions, which are scientifically verified and tested in practice of developed countries. Without this, we cannot develop a legitimate state in our country. Moreover, the rule-of-law state is the only legitimate state, because only a rule-of-law state is established by civil society, which is the only source of state power and functions with the consent of the will of the same civil society.
